A 24 Lot Subdivision developed by Somerset Development Corporation
Land Use
No lot shall be used except for single family residential purposes. All
lots shall be restricted from further subdivision for the purpose of
creating additional residential lots.
Time Frame
Owner shall start construction of primary resident within 12 months from
date of lot purchase. Primary residence and other approved buildings
shall be completed within 12 months from start of construction, unless
otherwise approved by the Design Review Committee.
Dwelling Size
No dwelling may have less than 2,400 sq. ft. of finished living area above
grade. A two story and one and one-half story dwellings shall have a
minimum of 1,500 sq. ft. on first floor. Finished living area shall be
heated space, exclusive of garages, basements, attics, decks and porches.
Design
House, accessory buildings, landscape plans shall be submitted and approved
by the Design Review Committee.
Materials
Exterior materials and colors shall be harmonious and compatible with neighboring
buildings. Exterior materials shall be brick, stone, or wood siding.
Vinyl and aluminum siding will not be permitted. Color schemes and materials
are subject to review and approval by Design Review Committee.
Accessory Buildings
Detached accessory buildings, greenhouses, kennels, swimming pools, and
pool houses, gazebos, tennis courts and facilities shall be allowed.
These structures shall be of a design and use of materials that shall
match and compliment the residence. (a.e.: brick, stone, siding, etc.)
Factory finished painted metal rib siding and roofing may be used in
combination with brick or stone for a compatible material for accessory
buildings. The structures shall be submitted to the Design Review Committee
for approval.
Garages
Garages shall be attached or detached and be a minimum of 2 ½ car
size. Garage entry shall be side or rear entry, facing the side or rear
lot lines.
Roofs
Roofs shall be dimensional fiberglass shingles, wood shake shingles or
slate shingles. Color subject to review and approval by the Design Review
Committee.
Driveways
All driveways shall be paved with asphalt, concrete or brick as soon as
weather permits upon completion or residence.
Fences
Materials, design and location of fences are subject to review and approval
by the Design Review Committee. Fence types are encouraged to match development
fence- (a.e.: 4 board horizontal, almond color, maintenance free material)
or “wrought iron” style. Chain link and similar fences are
not acceptable except in a kennel configuration and location that is
approved by the Design Review Committee.
Landscape
Each owner shall submit a landscaping plan for review and approval by the
Design Review Committee. Each plan shall contain at least 2 trees of
2” minimum caliper in front yard area. Landscaping shall be installed
as soon after completion of the building as season permits.
Building Location
Building setback lines are hereby established as shown on the plat. Side
lot setbacks shall be a minimum of 30’ feet.
Maintenance
Owners shall keep individual lots mowed and maintained in a neat and tidy
appearance from date of purchase.
Prior to construction activities, owner or owners’ contractor shall install a stone driveway and culvert as required, erosion control fence along all down slope areas around construction site and street ditches. All construction traffic shall use the driveway only for lot access.
Utilities
All utilities serving individual lots shall be placed underground.
Animals
No animals, livestock or poultry shall be raised, bred or kept on any lot,
except dogs, cats or customary household pets may be kept, provided that
they are not kept, bred or maintained for any commercial purpose and
do not create a nuisance.
Parking
No vehicles, boats, trailers, campers, recreational vehicles, shall be
kept on a lot unless stored in a garage or approved enclosed accessory
building.
Temporary Structures
No temporary structures, trailers, tent, garage, barn shall be used on
any lot at any time as a residence either temporarily or permanently.
Antennas, Satellite Dishes
All antennas, satellite dishes shall be located in an inconspicuous area,
and approved by the Design Review Committee.
Signs
No sign of any kind shall be displayed to the public view on any lot, except
ordinary 2’ x 2’ “For Sale” signs, without the
prior approval of the Design Review Committee.
Accessory Propane Gas Tanks
Accessory Propane Gas Tanks shall be permitted. Tanks shall be bury type
and installation location shall be approved by the Design Review Committee.
Nuisances
No noxious or offensive activity shall be carried on or permitted by any
lot, nor shall anything be done therein which may be, or may become an
annoyance or nuisance to the neighborhood.
Mailboxes
Mail delivery shall be to individual mailboxes for each lot. These mailboxes
shall be alike, and type and design shall be chosen by the Design Review
Committee for a neighborhood effect. The mailboxes shall be provided
by the Design Review Committee at a cost not to exceed $200.00 to each
owner.
Design Review Committee
The Design Review Committee shall be composed of the developer and 1 (one)
lot owner appointed by the developer. In the event of death or resignation
of any member of the committee, the remaining members shall have full
authority to designate a successor. Upon the sale of all lots, the developer
shall designate successors.
Somerset Meadows Neighborhood Association/Assessments
An annual assessment shall be imposed for each 24 lots, to defray the costs
of landscaping at the entrance area, buffer areas, and medians within
the development, electric usage for street lights, and maintenance of
the common areas within.
The initial maximum assessment shall be $125.00 per year per lot.
The neighborhood association shall be composed of the developer and 2 lot owners appointed by the developer. In the event of death or resignation of any member of the committee, the remaining members shall have full authority to designate a successor. Upon the sale of all lots, the developer shall designate successors.
